Insolvency & Corporate Restructuring

Our insolvency group assists clients in developing solutions and mitigating the impact of insolvency.

Our practice focuses primarily on corporate insolvency, receiverships, work outs, restructures, and liquidations of various types.  We have extensive experience with proceedings under the Bankruptcy and Insolvency Act, the Companies Creditors Arrangements Act, and the various applicable provincial statutes.  We represent primarily secured creditors (including corporations and financial institutions) and insolvency practitioners (receivers, trustees, monitors and liquidators).  Our insolvency lawyers have appeared in various levels of Court, in Nova Scotia, Prince Edward Island, New Brunswick, and Newfoundland and Labrador, and we also have experience with cross border (Canada – US) insolvency matters.  We have experience with various industries, including agriculture (fishing, farming and forestry), manufacturing, commercial real estate, and retail sectors.

Our insolvency lawyers are proud of their long-standing involvement with the insolvency community, having served on the Board of Directors of the Canadian Insolvency Foundation, vetted educational materials and attended consultation sessions for the Canadian Association of Insolvency and Restructuring Practitioners (CAIRP) and Canada Revenue Agency, and served on the board of oral examination for licensing of trustee candidates.  We regularly present, both in person and in writing, on insolvency issues in various forums, including the Canadian Bar Association (CBA), CAIRP, and the Law Society of Upper Canada.
